MiFit Terms & Conditions
A: Definitions

'You'; 'Your' – the person applying for membership

'We'; 'Our'; 'Us'; 'the Club' – MiFit, a trading style of JJB Sports Plc whose registered office is Challenge Way, Martland Park, Wigan, Lancashire, WN5 0LD, and including any MiFit club premises that you attend as a member.
B: Membership

Fees
-
Membership will be charged at a monthly rate payable at the start of the period of membership.

We may from time to time review and revise the amount and structure of membership fees and we will give you 10 days notice of any change.

All fees paid are non-refundable except in accordance with Clauses 3.1-3.3 below (Cancellation).

If you cancel your membership and wish to rejoin, a new activation fee will be payable.

Members
-
You must be over the age of 16 to be a member of MiFit. By completing the application you are telling us that you are over the age of 16.

If you are under the age of 18, you must undertake a mandatory orientation session before using the exercise facilities.
-
Membership is conditional on the satisfactory completion online of a Pre-Activity Readiness Questionnaire.

We may refuse membership at our absolute discretion.

Cancellation and Termination

You have the right to cancel your membership without notice within 7 working days of joining, from and including the day after the payment is made. If you choose to cancel your membership within this period, any fees paid will be refunded to you in full UNLESS you have used the Club facilities, in which case no refund will be made.

To cancel your membership in this period you must email admin@mifit.com and your refund will be made by the same method you initially paid by. Where this is not possible, we will use another reasonable method at our discretion.

You may cancel your membership at any other time by cancelling your Direct Debit with your Bank.

We will terminate your membership if
-
Your membership key is used by another person to gain access to the Club;
-
You commit any illegal act while on Club premises.

We may at our absolute discretion terminate your membership if –
-
You break any of the Membership Rules;
-
You behave in a violent or threatening manner towards another Club member or an employee of the Club whether or not on the Club premises;
-
You cause any damage to the Club premises or equipment other than as a result of a failure of that equipment during its intended use.
-
If we exercise our right to terminate your membership, we may do so with immediate effect and we will not accept any future membership application from you.
C: Entry to Mifit Clubs

Membership keys remain at all time the property of the Club and must be returned upon cancellation of your membership by you or us.

Access to the Club will only be allowed upon production of your membership key.

Lost keys will be cancelled and a replacement issued for a fee of £10.
-
You must notify us immediately if your key is lost, missing or out of your possession.

We may in our absolute discretion refuse entry to the Club if, in our opinion:
-
You appear to be intoxicated;
-
The membership key presented is not your key;
-
There is any other good reason to refuse entry.

We may at our discretion amend the opening hours of the Club. Where it is reasonable to do so we will endeavour to give you 1 week's notice of such a change, unless the change is temporary.
D: Liabilities and Responsibilities

Property
-
While we will provide Lockers at our Clubs, we do not guarantee the availability of a Locker to you at the time of your visit.

We accept no responsibility for any damage to or loss of property except to the extent caused by any negligence on our part.

We assume no responsibility for the personal belongings of members or visitors.

General
-
A member or visitor engaging in the Club's activities or making use of its facilities is responsible for ensuring that he or she is properly equipped and that he or she is in sufficiently good health such as to avoid any undue risk to himself or herself or others visiting the Club.

We accept no responsibility for accident, injury, illness or misadventure caused to or suffered by members or guests on the Club premises howsoever caused, save as may be caused by the wilful default or negligence of the Club, its servants or agents.

We will use our reasonable efforts to ensure that the equipment in our Clubs is maintained in good working order. It is not guaranteed that:

All equipment in the Club will be in working order at all times;
-
Any particular equipment will be available for your use.
-
We may carry out repairs, maintenance or alternations without prior notice.

If your physical condition changes such that you would, if presented with the Pre-Activity Readiness Questionnaire, give different answers to those you gave on joining, you must issue the club with a Doctors letter to confirm that you are cleared to continue exercising.
E: This Agreement

We may alter these Terms and Conditions and the membership Rules. If we do so, we will give you 1 weeks notice.

If any part of this agreement is deemed unenforceable by a Court, the remainder of the agreement will continue to stand.
F: Governing Law

This Membership Agreement is governed by the law of England and Wales
Direct Debit Mandate Guarantee
This Guarantee is offered by all Banks and Building Societies that take part in the Direct Debit Scheme.
The efficiency and security of the Scheme is monitored and protected by your own Bank or Building Society.
If the amounts to be paid or payment dates change JJB Sports plc will notify you 10 working days in advance of your account being debited or as otherwise agreed.
If an error is made by JJB Sports plc or your Bank or Building Society you are guaranteed a full and immediate refund from your branch of the amount paid.
You can cancel a Direct Debit at any time by writing to your Bank or Building Society. Please also send a copy of your letter to us.
Sunbed Health and Safety Information
It is essential that you understand the aspects, possible dangers and safe practice of indoor tanning.
Please Read the Following Carefully:
An indoor tanning system should be treated with the same amount of caution as normal sunlight. It is important to build up your tan gradually, particularly if you have sensitive skin.
Never repeat tanning treatment if any signs of redness remain from previous sunbathing or tanning. Wear goggles or approved protective eyewear (available free from reception). Remove contact lenses, keep eyes closed and avoid looking directly at the light tubes. Do not tamper with or touch the light tubes whilst using the equipment.
Health and Safety information relating to sunbed use is prominently displayed adjacent to the sun units. Please read it prior to use.
IF YOU SUFFER FROM THE FOLLOWING PLEASE CONSULT YOUR DOCTOR BEFORE USING THE SUNBEDS:
Ill effects from normal sunbathing, epilepsy, giddiness or fainting, headaches or migraine, freckles, moles, family history of skin cancer, a heart condition, hypertension, prickly heat, cold sores, allergies, skin ulcers or taking any form of prescribed drug, ointment/lotion, antibiotic or tranquillizers, that is worsened by sunlight, diabetic, pregnant or hypersensitive to light?
CAUTION: YOUR SKIN MAY BE EXTRA SENSITIVE IF YOU HAVE HAD THE FOLLOWING SKIN TREATMENTS IN THE LAST 24 HOURS;
Hot waxing, bleaching or electrolysis.
Do not use cosmetics, deodorants or similar preparations prior to tanning.
I have read and understood the above. I am over 16 years of age and understand the necessary precautions for indoor tanning sessions.
Please note on regular intervals throughout the year the tanning equipment will be re-tubed. Please take this into account when using the tanning equipment, as the strength of the tubes will be greater. Notices will be displayed at this time. You may wish to reduce the length of time spent using the equipment.
Pre-Exercise MEDICAL Screening

Has a Doctor/Medical Professional ever diagnosed you with a heart condition and indicated you should restrict your physical activity?

When performing physical activity, do you feel pain in your chest?

When you were not engaging in physical activity, have you experienced chest pain in the past month?
-
Do you ever faint or get dizzy and lose your balance?
-
Do you have an injury or orthopaedic condition (such as a back, hip, or knee problem) that may worsen due to a change in your physical activity?
-
Do you have high blood pressure or a heart condition in which a Doctor / Medical Professional is currently prescribing a medication?

Are you pregnant?
-
Do you have insulin dependent diabetes?
-
Are you 69 years of age or older and not used to being very active?
-
Do you know of any other reason you should not exercise or increase your physical activity?
Condition
If you have answered yes to any you will not be able to join MiFit and we recommend that you obtain medical advice before undertaking an exercise programme.
To ensure maximum physical fitness to you and to increase your safety within the club, we strongly recommend that you undertake the supervised induction whatever your physical condition.
Declaration

I confirm that I understand that there are health risks to undertaking exercise, that it is recommended that I should consult my doctor before undertaking a programme of exercise and that MiFit recommends that I have an orientation before I use the Club facilities.

I confirm that I have completed the Pre-Activity Readiness Questionnaire accurately and to the best of my knowledge and belief.

I understand that I must tell MiFit immediately if I become aware of a change in my circumstances as covered by the Questionnaire.

I confirm I have read and understood the Terms and Conditions and the Membership Rules and I understand that by completing the application process I am agreeing to be bound by those Rules and that I am entering into a legally binding contract.

I understand and accept that MiFit operates CCTV cameras at it's premises and that the recording and storage of images may occur in accordance with MiFit's policy.

I understand that I may only use the tanning facilities when I am over the age of 18.
I understand that ALL membership fees are non-refundable.
I have read, understand and accept the rules, terms and conditions laid down by the club and agree to abide by them. I understand that the club may from time to time make changes to the club without prior notice.
